1. General

The website www.vertimac.com (hereinafter the “Website”) and the platform www.platformparts.com (hereinafter the “Platform”) use cookies and similar technologies. This Cookie Statement (hereinafter the “Cookie Statement”) aims to inform you as a visitor about the use of cookies and similar technologies (see section 2). Vertimac BV acts as controller within the meaning of Article 4(7) GDPR for the personal data processed by means of these cookies, except where the table in section 4 identifies a third party as controller. This Cookie Statement is issued pursuant to Article 5(3) of Directive 2002/58/EC, as transposed by Article 129 of the Belgian Act of 13 June 2005 on electronic communications, and Articles 12 and 13 of Regulation (EU) 2016/679.

In addition to this Cookie Statement, Vertimac BV (hereinafter “Vertimac”, “we”, “us”) also provides a Privacy Statement, of which this Cookie Statement forms an integral part and which you can consult at [insert the English URL of the Privacy Statement, hyperlinked]. For the collection and further processing of your personal data in general and your rights thereon, please refer to this Privacy Statement. This Cookie Statement explains the concrete way in which we use cookies on our Website and Platform.

We would like to point out to you as a visitor that you do not have to accept all cookies. Accepting them is not a condition for visiting the Website or the Platform. However, if you refuse them, certain functions of our Website and Platform and additional services may not function optimally (see also section 6, Manage cookies). Refusing cookies, or withdrawing your consent later, is free of charge and does not restrict your access to the Website or the Platform.

2. What are cookies?

Cookies are small information files that are stored by the internet browser on your computer or mobile device when you visit a website or when you use a (mobile) application. They allow the Website and the Platform to recognise your device and to store or retrieve information about the way you use them. The information a cookie holds, including an identifier assigned to your device, may constitute personal data within the meaning of Article 4(1) GDPR (see also recital 30 GDPR).

This Cookie Statement also covers technologies that have a comparable effect, such as pixels and web beacons, local and session storage, software development kits in applications, and device fingerprinting. Article 5(3) of Directive 2002/58/EC is technology-neutral: it applies to any storage of, or access to, information on your device, irrespective of the technique used.

Cookies may be placed by Vertimac itself (“first-party cookies”) or by third parties (“third-party cookies”). Third-party cookies ensure that certain data is transmitted by your visit to or use of the Website and the Platform to the third party that placed the cookies. The identity of each third party is set out in the table in section 4.

Cookies are sometimes placed temporarily (“session cookies”, these are deleted when you close the browser) and sometimes permanently (“persistent” cookies, these remain in place until they expire or until you delete them). The maximum storage period of each cookie is stated in the table in section 4.

3. What do we use cookies for?

We use cookies for the purposes set out below. For each category we state whether your consent is required and on what legal basis the cookie is placed.

Strictly necessary cookies

Strictly necessary cookies are necessary for purely technical reasons to enable communication between your device and the Website and the Platform, or to deliver a service you have expressly requested. These cookies are therefore necessary for the use of the Website and the Platform.

They are exempt from the consent requirement under Article 129, 1° of the Act of 13 June 2005, transposing the second sentence of Article 5(3) of Directive 2002/58/EC. Where personal data is processed by means of these cookies, we rely on our legitimate interest in a secure and properly functioning website (Article 6(1)(f) GDPR) or, on the Platform, on the performance of a contract with you (Article 6(1)(b) GDPR).

Functional cookies

Functional cookies ensure that the basic functionalities of our Website and Platform work properly. These cookies are only placed after you as a visitor have taken a certain action on the Website or the Platform (e.g. placing products in your shopping basket).

Where a functional cookie is strictly necessary to deliver a function you have expressly requested, it falls under the exemption described above and cannot be switched off through the cookie banner; you can still block or delete it through your browser (section 6), although the Website and the Platform may then not work correctly. Where a functional cookie is not strictly necessary for such a function, we place it only with your prior consent.

Analytical cookies

Analytical cookies enable us to find out more about how you, as a visitor, deal with and react to the content of our Website. This enables us to design our Website and Platform even better. The information in question is used to create and analyse web statistics at a total level. We require your consent for the use of analytical cookies (Article 129, 2° of the Act of 13 June 2005 and Article 6(1)(a) GDPR). You can accept or refuse each category of non-essential cookies on the first layer of the cookie banner that appears when you first visit the Website or the Platform. Refusing is as simple as accepting, and no non-essential cookie is placed before you have made your choice. Your consent must be free, specific, informed and unambiguous within the meaning of Article 4(11) GDPR; continuing to browse, scrolling, or leaving a pre-ticked box unchanged does not constitute consent. To withdraw your consent at a later stage, please refer to section 6.

Marketing and social media cookies

Marketing cookies build a profile of your interests in order to show you advertisements that are relevant to you, on our Website and Platform or elsewhere. Social media cookies allow you to share content through third-party platforms. These cookies are placed only with your prior consent (Article 6(1)(a) GDPR) and are always listed individually in the table in section 4.

We ask for your consent again at least every six months, and in any event before we place a new non-essential cookie or use an existing cookie for a new purpose.

Where a cookie is placed by a third party, that third party processes the data it collects for its own purposes and under its own privacy policy. The table indicates whether this involves a transfer of personal data outside the European Economic Area; section 5 explains the safeguards applied.

5. Storage periods and transfers outside the EEA

Each cookie is stored for no longer than the period stated in the table in section 4. Personal data derived from cookies is retained in accordance with the retention periods set out in our Privacy Statement.

Some of the third parties named in section 4 are established outside the European Economic Area, in particular in the United States. Where personal data is transferred to such a party, we rely on the European Commission’s adequacy decision of 10 July 2023 on the EU–US Data Privacy Framework, provided the recipient is certified under that framework. Where it is not, the transfer takes place on the basis of the standard contractual clauses adopted by Implementing Decision (EU) 2021/914, supplemented where necessary by additional safeguards following a transfer impact assessment (Articles 44 to 49 GDPR). You may request a copy of these safeguards using the contact details in section 8.

6. Manage cookies

The following explains how to change your cookie preferences. Strictly necessary cookies cannot be switched off through the cookie banner, because the Website and the Platform cannot function without them; you can still block or delete them through your browser settings, as explained below.

You may withdraw your consent to non-essential cookies at any time, and it is as easy to withdraw your consent as it was to give it (Article 7(3) GDPR). Withdrawal does not affect the lawfulness of the processing carried out on the basis of your consent before you withdrew it.

Via the website

You can set your cookie preferences at any time through the Website by clicking on ‘Cookie settings’ at the bottom of the Website. This will open the drop-down menu, which allows you to enable or disable non-essential cookies via the buttons provided for this purpose. You can then save your cookie preferences by clicking ‘Save’.

Via your browser

In addition, you can change your cookie preferences through your browser. In this way, you can indicate whether certain cookies may be placed and you can set your browser to receive a message when a cookie is placed. You can also delete cookies manually via the option that allows you to delete your browsing history. More information about this can be found on the pages below, depending on which browser you are using:

Your browser settings apply to that browser and that device only, and they are not a substitute for the choice you make in the cookie banner. Deleting cookies in your browser also deletes the cookie in which your preferences are stored, so the banner will appear again on your next visit.

Disabling cookies may result in certain applications of our Website and additional services not functioning optimally.

7. Changes

We may amend this Cookie Statement, for instance when we deploy new cookies or when the applicable legislation changes. Each modified version is online and can be found on the Website and Platform. The modified Cookie Statement is immediately applicable as of its publication. Publication does not, however, in itself authorise the placing of new cookies: if we introduce a new non-essential cookie, or use an existing cookie for a new purpose, we will ask for your consent again before doing so.

The date and version number of the current text appear at the top of this Cookie Statement. Earlier versions are available on request.
